Summary of Divorce Procedure
First we take your instructions and advise you on whether or not you have grounds for a divorce. We then prepare the Divorce papers and deal with all matters with the Court
up to and inclduing the granting of the Decree Nisi which is the first stage of the Divorce. After the 'cooling off period' required by the Court, we then apply for the final Decree of Divorce - the Decree Absolute - after which you and your former spouse are now free to remarry. Sometimes a party may wish to obtain a Decree Absolute before the normal time usually allowed by the Court for reasons such as a desire to remarriage. In such circumstances we will be happy to advise on the procedure available for applying to the Court for an early Decree Absolute.
Financial matters - sometimes known as 'Ancillary Relief'
We can also provide you with comprehensive advice on any financial aspects associated with your divorce. Where there are many assets or where the situation is complex we susually back up any advice with the Opinion of a barrister with specialist expertise in this area. Financial settlements can be extremely expensive - resulting in less in the pot for both parties to share. We therefore normally urge clients where possible to see whether agreement cannot be reached with their spouse regarding any proposed financial settlement. Where this proves not to be possible, we assist you with all procedures leading to a final Order of the Court.
Deeds of Separation
Sometimes the two parties to a marriage will have reasons why they do not wish even though they wish to lead separate lives. We can assist with Deeds of Separation setting out the terms on which you have decided to separate.
