Summary of Conveyancing Procedure
Sale
You will no doubt have heard the hype about Home Information Packs, commonly known as HIPs. Since October 2008 it has been compulsory for all persons marketing their homes for sale to the public to provide Home Information Packs for the potential buyers' inforation. The main documents contained in the packs are a local authority search, a water and drainage search and a land registry snapshot showing such matters as the identity of the owners of the property and whether there are any mortgages secured against the property. You will also need to provide an Energy Performance Certificate with the Pack. We are able to provide Home Information packs at competitive rate so do contact us before you go anywhere else. BUT remember, if your transaction is a private sale, you are not required to provide a HIPs
Once you have found your buyer, we will send you the necessary forms to complete. We will prepare the Contract package and forward all necessary documents to your buyer's solicitors. We will deal with all their enquiries as necessary . Following exchange of Contracts we will obtain a redemption statement from your mortgage lender if applicable and we will then take care of all matters up to and including completing your transaction.
Purchases
On receipt of the Contract package from the seller's solicitors we go through all the documents following which we send you a full report with copies all all relevant documents. You then have the opportunity to ask any questions concerning the property. If you are happy to proceed, and for those buying with the aid of a mortgage - if your mortgage offer has been received, we deal with all the requirements of the lender connected with the mortgage.
We then exchange contracts on your behalf and arrange a completion date with is usually between one and two weeks following exchange. Although if you are in a hurry to complete we can usually facilitate an earlier completion. Following completion we can usually provide you with the Land Registgry Confirmation of registration of your purchase wihin 4 weeks of completion.
Remortgages/Equity Releases
We can also assist you where you have decided to remortage or release cash or 'equity' from your property. This transaction is usually more straightforward than a sale or purchase and we can usually complete your remortgage/'equity release' within 10 days from the date of receiving a copy of your mortgage offer from your lender.
Property Transfers
There are several circumstances in which you may want to transfer ownership of your property - whether it is from one to several persons or vice versa. Do remember that there are particular Stamp Duty rules which apply to these types of transfers and we will be happy to advise you on these. As withRemortgages, we can usually completey these types of transactions within around 10 days from receipt of your instructions or a copy of any mortgage offer attached to the transfer.
